Legal Requirements for – Early Years Providers

Early years providers have a legal requirement to ensure that they have adequate first aid provisions in place for nurseries, childminders, and schools.

Legislation

On September 1, 2025, the Early Years Foundation Stage (EYFS) received an update that divided it into two categories. This change aimed to provide new guidance to help providers distinguish between schools and childminders.

The two categories are;

Group- and school-based providers.

For childminders.

At least one person with a paediatric first-aid certificate must be present at all times when children are on site and able to respond quickly in case of an emergency.

Childminders and any assistants responsible for children for an extended period must hold a valid two-day paediatric first aid certificate.

Paediatric First Aid Training

Warwickshire First Aid Training offers the QNUK Level 3 Award in Paediatric First Aid (RQF), a 2-day course that covers all requirements for early years providers.

We only offer the course as a customer site option to ensure it aligns well with your first aid requirements and outcomes.

We also provide the QNUK Level 3 Award in Emergency Paediatric First Aid (RQF), which is an excellent qualification if you already have a Level 3 Award in Paediatric First Aid on your premises during business hours.

Our paediatric first aid courses are OFQUAL-regulated and fulfil Department for Education and EFYS requirements.
